Welcome to PorchPop. These terms are the agreement between you and PorchPop for using our app and website. Please read them โ by creating an account or using PorchPop, you agree to them. We have kept them as plain as we can.
1. PorchPop is a discovery venue, not a party to your sale
PorchPop is a place to discover local farm stands, home bakers, and sweet-treat makers. We are not a party to any transaction between a buyer and a vendor. We do not process payments, we are not anyone's agent, and we do not sell, prepare, deliver, or handle any food. Any purchase, pickup, payment, or arrangement is strictly between the buyer and the vendor. That includes preorder requests: PorchPop only passes a buyer's request and the vendor's response between the two of you. Any resulting order, payment at pickup, change, or cancellation is between the buyer and the vendor โ we are not part of it.
2. Listings are user content โ we don't verify them
Vendors create their own listings, reviews, and photos. We do not verify the accuracy of any listing, whether a vendor holds the right permits, or whether anyone complies with food-safety or other laws. Allergen information is provided by vendors and is not verified by PorchPop. If you have a food allergy or sensitivity, you must confirm directly with the vendor before buying or eating anything. Do not rely on PorchPop for the accuracy or safety of any food.
3. Vendor obligations
If you list on PorchPop as a vendor, you agree that:
- You will comply with your state's cottage food law and all other laws that apply to you.
- You will label your products as your state requires, including allergen and home-kitchen labeling.
- You will only sell what your state permits you to sell.
- Your in-app attestation โ that you follow your state's cottage food law and label your products as required โ is true and binding. PorchPop educates and links out on these rules; it never tells you what is legal in your state, and it does not verify or certify your compliance. That responsibility is yours.
4. Indemnification and release
If you are a vendor, you agree to indemnify PorchPop โ that is, to cover us and hold us harmless โ from any claims, damages, or costs arising out of the food you make or sell, your listings, or your conduct.
Because deals happen directly between users, you release PorchPop from any dispute you have with another user. If a disagreement comes up between a buyer and a vendor, it is between the two of you.
5. Acceptable use and our moderation rights
Use PorchPop lawfully and respectfully. Don't post anything false, unsafe, harassing, infringing, or otherwise inappropriate. Don't misuse information you learn through PorchPop โ a vendor's address is revealed to you for visiting their stand or picking up an order, and using it for anything else (harassment, unwanted contact, scraping, or republishing) is prohibited and grounds for immediate removal. We may review, remove, or refuse any content, and we may suspend or remove any account, at our discretion โ for example, when content breaks these terms. The app provides tools to report and block content and users, and we encourage you to use them.
Your content and the license you give us
You keep ownership of the content you post. You grant PorchPop a non-exclusive, worldwide, royalty-free license to host and display your content within the app and its normal operation, so we can show your listing to buyers. You are responsible for the content you post and confirm you have the right to share it.
6. No warranties
PorchPop is provided "as is" and "as available," without warranties of any kind, whether express or implied. We do not warrant that the app will be uninterrupted, error-free, or that any vendor, listing, or food will meet your expectations.
7. Limitation of liability
To the fullest extent the law allows, PorchPop will not be liable for any indirect, incidental, or consequential damages. Our total liability to you for any claim is limited to the greater of $100 or the amount you have paid us โ which, for a free app, is $0.
8. Who can use PorchPop
You must be at least 13 years old to use PorchPop. To sell as a vendor, you must be at least 18 (or have your parent or guardian's consent and the legal capacity to enter this agreement).
9. Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
10. Changes to these terms
We may update these terms from time to time. If we make a material change, we will update the effective date above and give notice where appropriate. If you keep using PorchPop after a change takes effect, you accept the updated terms.
11. Termination
You can stop using PorchPop and delete your account anytime from Settings. We may suspend or end your access if you break these terms. Sections that by their nature should survive โ like indemnification, disclaimers, and limitation of liability โ continue after termination.
